OFFICIAL 2016 TEACHER APPRECIATION CONTEST RULES & REGULATIONS
The 2016 “Teachers Appreciation” Contest (the “Contest”), is sponsored by 2016 EF Education First International Ltd (the “Sponsor”). The Contest is intended to be conducted in Canada only and shall be governed by the laws in force in the Province of Ontario. Eligibility for participation in the contest is limited to residents of Canada. Other criteria for eligibility are set out below.

1. The Contest: Beginning on May 17th, 2016 until 11:59 pm Eastern Standard Time (“EST”) on June 10, 2016 (“Nominator Contest Period”), eligible residents of Canada (“Nominators”) can nominate teachers (“Nominees”) to be considered for the Grand Prize. By submitting a nomination during this time period, Nominators are considered for the Nominator prize. All prize values will be listed in Canadian dollars. By entering the Contest, Nominators and Nominees agree to abide by these Official Contest Rules & Regulations (the “Contest Rules”) and the decisions of the Sponsor with respect to all aspects of the Contest, which are final and legally binding on the Nominators and Nominees. By participating in the Contest, the Nominators and Nominees similarly agree to the following.

Nominators and Nominees may win the prizes under the Contest, as follows:
(a) Nominator Contest: All valid entries that the Sponsor receives from eligible Nominators shall entitle all such entrants the opportunity to win the General Prize, $500 Best Buy gift card valued at $500.00 (with no trade in value). A random draw for the General Prize will be held at 60 Bloor Street West Suite 501, Toronto, Ontario at 4:00 PM EST on June 14th, 2016 at the Sponsor’s offices. The winner of such prize shall be notified by the Sponsor by email, mail, courier or telephone by June 21st, 2016. 
(b) Teacher Contest: A judges panel selected by the Sponsor will select the best teacher nominations from all valid entries received from eligible Nominators. The selected nominee will be notified by the Sponsor by email, mail, courier or telephone to acknowledge their nomination and winning of the Contest. All persons selected as winners of the Nominator’s Contest and Teacher’s Contest shall comply with the following conditions in order to receive any prize: 

(i) They shall provide to the Sponsor a signed waiver, release and agreement (a “Release Form”) in a form acceptable to the Sponsor within 4 business days after notice has been provided to them by the Sponsor. Such form shall acknowledge and certify their acceptance of and compliance with the Contest Rules and provide their agreement to the provision, use, storage and transfer of their personal information and likeness (as well as any other information provided by them) in accordance with the Contest Rules, including without limitation through Facebook, Twitter, the Sponsor’s website and in print and other news publications. It will also release the Sponsor and its subsidiaries, affiliates, related companies or agencies, and their respective officers, directors, employees and agents from all liability with respect to participation by the entrant or teacher in the Contest; and (ii) They shall correctly answer a time-limited mathematical skill-testing question without assistance of any kind.
By entering or participating in the Contest, each Nominator and Nominee agrees to accept the decision of the judges, regardless of the basis or outcome of such decision-making.

2. How to Enter: No purchase necessary. One entry per person. Beginning on May 17th, 2016 until 11:59 pm EST on June 10th, 2016, the method of applying for the Contest is: 
Online: Enter online at eftours.ca/TeachersRock by completing the entry form provided. Completion shall require an eligible Canadian submitting certain information about an eligible teacher that the Nominator believes is worthy of being considered for the Teacher Contest. This includes the Nominee’s first name, last name, profession, school address (including postal code), school name, grade taught, office telephone number and area code, written feedback about the Nominee. Prior to nominating a 
teacher, the Nominee’s consent should be obtained, including as to the provision of his or her personal information. A Nominator will be required to submit his or her first name, last name, profession, home address including postal code, telephone number and area code, email address and to confirm that he or she has read and agreed to be bound by the Contest Rules. Once an online form has been completed, the entrant must formally submit it by clicking “submit”.

3. Nominator and Nominee eligibility: Nominees must be residents of Canada and be of the age of majority, and must be employed full or part-time as a teacher or administrator at a middle school, junior high school or senior high school. Nominators must be residents of Canada. Neither Nominators nor Nominees will be eligible if (1) they are employees of the Sponsor, its subsidiaries, affiliates, related companies or agencies, (2) members of their immediate families or any person with whom they are domiciled is an employee of one of the aforementioned entities, or (3) they are employees of any other company providing educational tours. Self-nomination by a teacher is permitted. Attempted entry by an eligible Nominator that nominates an ineligible Nominee may, in the discretion of the Sponsor, make both the Nominator and the Nominee ineligible for any prizes under the Contest.

4. Entry eligibility: Only fully completed and legible entries will be considered eligible entries. All entries received after the Contest Nominator Period and the Contest Teacher Period shall be deemed ineligible. Limit one entry per person for the Nominator Contest and Teacher Contest, regardless of method of entry. In the event of a dispute regarding the identity of a Nominator, the entry will be deemed to have been made by the authorized account holder of the email address submitted with the entry. The authorized account holder is defined as the person who is assigned an email address by an online service provider or other organization (business, educational institution, etc.).

5. Prizes: The available prizes are described below under the heading “the Grand Prize”. The Sponsor makes no representation, warranty or covenant in respect to any prize provided in connection with the Contest, including without limitation any warranty or condition of merchantability or fitness for purpose. All prizes are awarded on an “as is” basis. Further terms and conditions apply as follows: 
(a) The Grand Prize: There will be one (1) Grand Prize available to be won by a selected Nominee amongst all eligible entries received by the Teacher Contest Closing Date, consisting of a professional development experience abroad (the “trip”) with an estimated retail value of $2,500. Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution permitted except at Sponsor's discretion. The prize is nontransferable. The prize must be redeemed by August 31, 2017. Any and all prize related expenses, including without limitation any and all federal, provincial/territorial and/or local taxes shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by the winner is permitted. Acceptance of prize constitutes permission for The Sponsor to use winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law. The Contest is not transferable. All EF Tours are subject to EF’s Booking Conditions (the terms of which can be obtained by calling 1-800-263-2806 or found at www.eftours.ca/bc. Each potential Teacher Contest recipient 
will be required to review and agree in writing to such Booking Conditions in advance of being awarded any Contest. A condition of accepting and being awarded such Contest will be compliance in full with such Booking Conditions. The Grand Prize winner will be contacted within two business days by an employee of the Sponsor and informed that he or she has been declared the winner.
(b) Grand Prize Winner Determination: The initial determination of the Grand Prize winner will be decided prior to 5:00 pm EST June 13, 2014. He or she will be selected from amongst the nominees received by the Sponsor, based on all valid entries by eligible nominators by the Nominator Contest Closing Date, 11:59 pm EST June 10, 2016. The Grand Prize winner shall be determined by the judges panel selected by the Sponsor, based on criteria such panel has established in its sole and absolute discretion. The decision of the judges is final and is not subject to appeal.
(c) Notifying the Potential Grand Prize Winner: The Grand Prize winner will be contacted by email, mail, courier and/or telephone no later than to June 20, 2016. If the selected teacher cannot be located or does not respond no later than 3 business days after being initially notified by the Sponsor, or if a package sent by mail or courier is returned as undeliverable, the selected Nominee will be disqualified and the runner up will be contacted from among the remaining members of the ten teachers originally selected as potential Grand Prize Winners by the judges. Such a process will continue 
until a winner is selected. The Sponsor will not be responsible for failed attempts to notify any selected teacher. 
(d) Declaring the Winner: In order to be declared a Grand Prize winner, the selected Nominee must, in addition to the other requirements set out above, ensure that the sponsor is provided a Release Form by any Teacher Contest recipient. The Teacher Contest recipient may be asked and shall provide additional releases of the Sponsor at such time. All Release Forms must be returned within the time period specified by the Sponsor or the Grand Prize will be forfeited by such winner. The selected Nominee may be required to furnish proof of identification and employment as part of the verification process. The Sponsor also reserves the right to require proof of eligible employment. The Sponsor reserves the right to disqualify any potential winner who cannot produce, within 3 business days of a request by Sponsor for same, proof of such employment (satisfactory to Sponsor). Should a selected Nominee be unable to accept the Grand Prize because of school and/or Board of Education policy, another Nominee will be selected as the Grand Prize winner. Limit of one prize per person. If the Grand Prize is forfeited by a winner for any reason whatsoever, the Grand Prize may be awarded to an alternate at the discretion of the Sponsor.
(e) Awarding the Grand Prize: An employee of the Sponsor will contact the confirmed Winner within 3 business days of receiving the duly completed documents to arrange for awarding of the Grand Prize.

6. Name and image of the winners: By accepting a prize and signing the release agreement, each prize winner consents to the use of his or her name, school name, city and province of residence/school, and/or photographs, without further remuneration, in connection with any publicity carried out by or on behalf of the Sponsor. Each Nominator and Nominee gives the Sponsor the legal right to use, modify and publish his or her submitted materials in any way the Sponsor sees fit, including without limitation in future brochures, websites, newsletters, social media and other campaigns without compensation.

7. General conditions:
(a) This Contest is subject to all applicable federal, provincial and municipal laws and 
regulations.
(b) All entries become the property of the Sponsor and none will be returned. No 
correspondence will be entered into except with the selected entrant.
(c) All entrants release the Releasees from any loss, damage or claims caused by or resulting from participation in the Contest, or the acceptance or use of the Grand Prize, including but not limited to any injury or damage to an entrant’s.
(d) The Sponsor is not responsible for typographical or other errors in the offer or 
administration of this Contest, including but not limited to, errors in advertising, the Contest Rules, or the announcement of the Grand Prize winner.
(e) No responsibility is assumed by the Sponsor for any inability of a potential Nominator to successfully enter the Contest for any reason, including any problems or technical malfunction of any internet or telephone network or broadcast transmission during the Contest. The Sponsor assumes no responsibility for falsified, late, lost, damaged, misdirected, garbled, or incomplete entries. Proof of transmission (screenshots, etc.) does not constitute proof of delivery.
(f) The Sponsor reserves the right at its sole discretion to disqualify any Nominator and Nominee from the Contest in the event it is determined by the Sponsor, in its discretion, that the Nominator and Nominee (1) have failed to comply with the Contest Rules, (2) have sought to gain an inequitable advantage in relation to other Nominators and Nominees, or (3) may bring the Contest or the Sponsor or its affiliates into disrepute.
(g) Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified.
(h) Any attempt by a Nominator or Nominee or any other person to deliberately damage any website or undermine the legitimate operation of this Contest may be a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek remedies and damages from any such person to the fullest extent permitted by law.(i) The Parties have expressly required that these Contest Rules and all documents and notices relating hereto be drafted in English. Les parties aux présentes ont expressément exigé que le présente règles de concours et tous les documents et avis qui y sont afférents soient rédigés en anglais. In the event of any discrepancies between the English language rules and the French language rules for this Contest, the English language rules shall prevail.
(j) All contest prize awards are stated in Canadian dollars.

8. Personal Information: The Sponsor respects your right to privacy. By entering this Contest, each Nominator and Nominee consents to the Sponsor collecting, storing and using the personal information submitted with his or her entry in accordance with its privacy policy, only for the purpose of administering this Contest unless the Nominator and Nominees otherwise agrees. To the extent that a Nominator provides personal information in relation to a Nominee, the Nominator shall be obligated to obtain the consent of such Nominee to such provision and the use of it by the Sponsor and other parties as contemplated under these Contest Rules. The Sponsor shall not be responsible for any failure by any Nominator or Nominee to obtain such consent from a Nominee. To view the Sponsor’s Privacy Policy, visit www.eftours.ca/privacypolicy.
