Photo Contest Rules and Regulations Contest Rules: 
1. How do I enter? Contestants must submit an original photo of themselves on tour with EF Educational Tours. Contestants must post and tag their photo with the hashtag #imwithEF and @eftourscanada OR contestants must submit their photos online at www.eftours.ca/photocontest and follow the website instructions.  
2. What are the contest dates? The contest starts at 10:00 a.m. (EDT) on February 15, 2020 and ends at 5:30 p.m. (EDT) on April 30th, 2020. 
3. Can I submit more than one photo? Yes, you can submit as many photos as you like, as long as they meet the entry guidelines.  
4. What can I win? We will give away 1 of 2 gift cards worth $100 CAD, for a total of 2 prizes.  
5. How will my photo be used? By submitting a photo, you agree to allow EF Educational Tours to use your photo and likeness on our digital media channels and in print. The full terms and conditions regarding photo usage can be found in the Regulations section below. 
6. When will the winners be announced? One winner will be selected on March 31, 2020 at 5:30 PM EST and the second winner will be selected on April 30, 2020 at 5:30 PM EST.  The first winner will be announced on or around April 6, 2020. The second winner will be announced on or around May 5, 2020. The winners will be announced via Instagram message, Facebook message, or Twitter message. 
8. Does the photo have to be taken on tour? We would love to see a photo of you on tour but we know that pre- and post-tour activities are also an important part of travelling. 
ELIGIBILITY: The EF Educational Tours Photo Contest (the “Contest”), is sponsored by EF Institute for Cultural Exchange Ltd. (the “Sponsor”). The Contest is intended to be offered in Canada only, and shall be construed and evaluated according to the laws in force in the Province of Ontario. The Contest is eligible to those who have reached the age of 13 in the province in which they reside at the date of entry. Employees of the Sponsor are not eligible to enter. Void where prohibited. The Contest is subject to all federal, provincial, and local laws and regulations. By entering the Contest, applicants agree to abide by these Official EF Educational Tours Photo Contest Rules (the “Contest Rules”) and the decisions of the Sponsor with respect to all aspects of the Contest, which are final and legally binding on the entrant. 
HOW TO ENTER: No purchase necessary to enter or win. To enter, post a photograph on your personal Instagram or Facebook account OR contestants must submit their photos online at www.eftours.ca/photocontest and follow the website instructions. The Instagram, Facebook, or Twitter text accompanying the photo must include the hashtag #imwithEF and @eftourscanada and depict the entrant on tour.  
The Contest will begin at 10:00 a.m. (EST) on February 15, 2020 and will end at 5:30 p.m. (EST) on April 30th, 2020 (the "Contest Period").


Photo Guidelines:

* Entries must be the original work of the entrant.

* Entrant may be, but is not required to be, depicted in the entry photo.

* Entries must not contain material that is inappropriate or indecent; contains profanity, nudity, sexual content; hateful content of any kind; content that promotes violence or harm to another living creature; or any other offensive content (as determined by Sponsor in its sole discretion).

* Entries must not contain material that promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing) or promotes any activities that may appear unsafe or dangerous.

* Entries must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.

* Entries must not contain advertisements, personal solicitations or commercial solicitations, or promote any political agenda or party. 

* Entries must not include any trademarks, logos, or copyrighted materials, other than Sponsor related materials, or advertise or promote any brand or product owned by any entity other than the Sponsor.

* Entries must not contain materials embodying the names, likenesses, photographs, or other identifying elements of any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without express written permission from the person or persons (or their estate) depicted in the Entry.

* Entries must be in keeping with Sponsor's image and not contain any material that could reflect negatively on the name, reputation, or goodwill of Sponsor, its subsidiaries or affiliates.

* Entries must not violate or encourage the violation of any law, rule or regulation. 
PRIVACY: By entering the Contest, entrants consent to the collection, use and disclosure of their personal information for the purposes of administering the Contest and for the purposes of understanding the needs and preferences of individuals or to develop, enhance, market and/or provide products and services. The Sponsor will collect, use and disclose personal information in accordance with the following criteria:

NAME AND IMAGE OF THE RECIPIENT: By entering the Contest, if selected as a potential recipient of a Contest prize, the entrant consents to the use of his or her name, city and province of residence, and/or photographs, without further remuneration, in connection with any publicity carried out by or on behalf of the Sponsor.

RULES: The Contest will be run in accordance with these rules, subject to amendment by the Sponsor (the "Rules"). Entrants must comply with the Rules and will be deemed to have received and understood the Rules by participating in the Contest. The terms of the Contest, as set out in the Rules, are not subject to amendment or counter-offer, except as set out herein. The Sponsor's decisions with respect to the Contest are final and binding. If any provisions of the Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. For criteria used in judging the photographs, see the Judging section below. Entrant must be the owner of the photograph, or otherwise have the right to submit the photograph for consideration in the Contest. Entrant must have the permission of all persons or models in the photograph to use their image for this Contest and to grant the publicity rights and other rights granted to the Sponsor in accordance with the Rules. All content submitted by entrants may be posted by the Sponsor, and by their agents and representatives, to public viewing galleries and may also be used on other Sponsor owned website to promote the Contest. 
PRIZES: Two (2) prize winners will each receive one (1) gift card valued at $100 CAD from the Sponsor. 
JUDGING, WINNING AND NOTIFICATION: Winners will be selected throughout the Contest Period and will be selected as follows. Prize Winners: Sponsor’s in-house panel of judges will choose one submission from all eligible entries received from entrants. The chosen image may be posted to a Facebook, Instagram, and Twitter album. The winning entrant will be notified through their Instagram, Facebook, or Twitter account and/or by email and/or phone if publicly available. In each case, the judges will be the Sponsor’s employees. The selection of the submissions will be at the sole discretion of the judges and will be based on the criteria of how well the photo represents the entrant travelling. Decisions made by the judges will be final and binding. 
CONDITIONS TO WIN: Before being declared a winner of any prize, the selected entrant will be required to sign a declaration and release form confirming compliance with Contest Rules and acceptance of prizes as offered; acknowledging the Sponsor and their respective agents’ right to publish or broadcast the winner’s picture, name, address, voice and statements without charge or further compensation other than the prize offered. In the event that a selected entrant is not eligible to claim the prize or does not claim the prize within 48 hours of their photo being selected as a winner, or is unwilling or unable to comply with the Rules, or any prize notification is returned as undeliverable, that entry will be disqualified and the prize will be awarded to another contestant. Winners may waive their right to receive a prize. Contest prizes are non-transferable, nonexchangeable, and non-refundable, have no cash value and must be accepted by the winner as awarded. The Sponsor reserves the right to substitute a prize of equal or greater value in the event that the specified prize is unavailable due to circumstances beyond their control. Entrants acknowledge that this is an EF Institute for Cultural Exchange Ltd Contest. By entering the Contest, entrants acknowledge that they have read, understood and agree to be bound by the Rules. 
FOR RESIDENTS OF QUÉBEC: Any litigation respecting the conduct or organization of a publicity Scholarship may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a Scholarship may be submitted to the Régie des alcools, des courses et des jeux only for the purpose of helping the parties reach a settlement. 
RELEASE: By entering the Contest, entrants acknowledge that they are releasing the Sponsor and their respective affiliates, sponsors, advertising and promotion agencies and the immediate family and household members of the above, and each of their respective affiliated companies, directors, officers, employees, representatives and agents from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession, or use of any prize, or rights of publicity or privacy, defamation, or portrayal in a false light. By entering the Contest, entrants also agree to fully indemnify the Sponsor and their respective directors, officers, employees, parent companies, subsidiaries, affiliates, related companies, suppliers, sponsors and agents and hold each of them harmless from any and all claims costs, losses, or damages of any kind arising out of or in connection with the Contest, including any use of the Prize, by any third parties. The Sponsor and their agents are not responsible for:

(a) any problems or technical malfunction of any computer online systems including Twitter or Instagram or Facebook, servers, access providers, computer equipment, software, failure of any e-mail entry on account of technical problems or traffic congestion on the Internet or any website, or any combination    

(b) any incomplete or inaccurate information, whether caused by the website users or by any equipment of programming associated with or utilized in the Contest, or by any technical or human error which may occur in the processing of entries; or

(c) the theft, destruction or unauthorized access to, or alteration of, entries or the website. The Sponsor reserves the right, in their sole discretion, to cancel, modify or suspend the Contest should a virus or bug or other cause beyond the reasonable control of the Sponsor or their agents corrupt the security or proper administration of the Contest. 
Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. If the identity of an online entrant is disputed, the authorized account holder in Instagram and/or Facebook at the time of entry will be deemed to be the entrant.
