OFFICIAL CONTEST RULES & REGULATIONS
The Win A Free Tour! Contest (the Contest), is sponsored by EF Institute for Cultural Exchange Ltd. (the Sponsor). The Contest is intended to be conducted in Canada only, and shall be construed and evaluated according to the laws in force in the Province of Ontario.
By entering the Contest, entrants agree to abide by these Official Contest Rules & Regulations (the Contest Rules) and the decisions of the Sponsor with respect to all aspects of the Contest, which are final and legally binding on the entrant.
1. HOW TO ENTER: No purchase necessary. Beginning on January 1, 2012 until June 30, 2012 (the Contest Period), there are two (2) ways for an eligible person to enter the Contest. The two methods of entry are:
(a)ONLINE: Enter online at www.eftours.ca by completing the entry form with your first name, last name, profession, address including postal code, telephone number including area code, email address, confirm that you have read and agreed to be bound by the Contest Rules, indicate whether you would like to receive additional information from the Sponsor about programs and promotions, and click submit.
(b) IN PERSON: Enter in person by visiting the EF Educational ToursTM conference booth and completing and submitting an entry form with your first name, last name, school name, subject taught, grade level taught, complete address including postal code, telephone number including area code, and email address at any of the following conferences: North Central Teachers Convention Association (Edmonton, AB, Feb 9-10 2012); Calgary City Teachers Convention Association (Calgary, AB, February 16-17 2012); Palliser District Teachers Convention Association (Calgary, AB, February 23-24 2012); South Western Alberta Teachers Convention Association (Lethbridge, AB, February 23-24 2012); Greater Edmonton Teacher Convention Association (Edmonton, AB, March 1-2 2012); North Central Zone Conference Educational Spring Fling (Prince George, BC, March 9 2012); Canadian Student Leadership Conference (Date and location TBD); Ontario Modern Languages Teachers Association (Toront, ON, March 29-31 2012); Ontario History Association Secondary School Teachers Association (Toronto, ON, dates TBD); Ontario Association for Geographic and Environmental Education (Date and location TBD); Ontario English Catholic Teachers Association (Toronto, ON, February 23-25 2012); Ontario Society for Environmental Education (Peterborough, ON, May 3-5 2012). Conference schedule is subject to change. Please speak with an EF Educational ToursTM Tour Consultant or Tour Manager (a Tour Consultant/Tour Manager) for details.
(c )Only fully completed entries will be deemed as eligible entries. All eligible entries must be received by 11:59 PM Eastern Standard Time (EST) on June 30, 2012 (the Contest Closing Date). Limit one (1) entry per person for the Contest, regardless of method of entry. In the case of online entrants, in the event of a dispute regarding the identity of an entrant, the entry will be deemed to have been made by the authorized account holder of the email address submitted with the entry. The authorized account holder is defined as the person who is assigned an email address by an online service provider or other organization (business, educational institution, etc.).
2. ELIGIBILITY: To enter and be eligible to win, a person must be a legal resident of Canada of the age of majority who is employed full or part-time as a teacher or administrator at the middle school, junior high school, senior high school, or Cégep level and who is not an employee of the Sponsor, its subsidiaries, affiliates, related companies or agencies, or a member of their immediate families or any person with whom they are domiciled, or an employee of any other company providing educational tours.
3. PRIZE: There will be one (1) Prize available to be won by a selected entrant from among all eligible entries received by the Contest Closing Date, consisting of a free EF Educational ToursTM tour for the winner and up to five (5) students (collectively, the Travel Guests) selected by the winner to a location of the winners choice, selected from the more than 300 predetermined itineraries available through EF Educational ToursTM Canada. The Prize includes: return economy class airfare tickets, departing from and returning to the Canadian International Airport closest to the Prize winners residence; overnight stays in tourist-class hotels with private bathrooms, based on double occupancy for the winner and triple or quadruple occupancy for the Travel Guests (with others of the same gender), and/or alternate overnight accommodation as outlined specifically in the selected tour itinerary; select meals as outlined specifically in the selected tour itinerary; the services of a full-time EF Tour Director for the duration of the tour; sightseeing tours as outlined specifically in the selected tour itinerary; visits to special attractions as outlined specifically in the selected tour itinerary; and transportation to and from all activities outlined specifically in the selected tour itinerary (transportation to and from free-time activities not included). If the Sponsor judges that air travel is not required due to the winners proximity to the tour destination, ground transportation will be substituted for return airfare at the sole discretion of the Sponsor. The Sponsor will provide consultation services with a Tour Consultant/Tour Manager to assist the winner in selecting a Prize tour itinerary appropriate for him or her and the Travel Guests (see Rule #7 for more information), for purposes of which neither Customized Tours, EF Voluntours or North American Bus Trips will be allowed to be selected. The winner will have thirty (30) days from the day on which he or she is contacted by the Tour Consultant/Tour Manager and informed that he or she has been declared the winner (see Rules #6 and #7 for more information) to make his or her decision as to which tour itinerary he or she chooses, and an additional thirty (30) days from the day on which he or she confirms his or her tour itinerary choice to make his or her decision as to who his or her Travel Guests will be by submitting duly completed Participant Applications. The Prize will be awarded to a maximum retail value of approximately $15,000 CDN, with the cost of the winners tour being covered completely (subject to the conditions and qualifications set out in these Contest Rules) and the remaining funds beingdistributed equally between the Travel Guests, or, at the sole discretion of the Sponsor. The dates for the tour must be booked at least ninety-nine (99) days prior to departure (the Booking) and the tour must be taken by June 30, 2014 (the Deadline). Certain blackout periods may apply. In the event that the Prize winner is not available to travel on the dates selected or by the Deadline, the Prize will be forfeited by such winner. The Sponsor reserves the right to change or modify its available tours, tour locations and/or dates due to acts of God and/or unforeseen circumstances. If the Sponsor is unable to consolidate the winner and his or her Travel Guests on the winners selected tour, the Sponsor will offer a comparable tour, if applicable, which may or may not include all countries on the original selected tour itinerary. If the Sponsor fails to offer a comparable tour (defined as having at least fifty (50) percent of the same overnight destinations as the selected tour itinerary), the Sponsor will offer alternate tour itineraries based on the winners preferred travel dates. In either such instance, the new tours program fee and departure fees will apply. If no alternate tour itinerary is found to be satisfactory to the winner, the winner may choose to forfeit the Prize and he or she and his or her Travel Guests will be refunded all monies paid to the Sponsor in relation to the Prize Tour, if applicable. If the winner wishes to increase the likelihood of travelling on his or her selected tour itinerary, he or she may add a minimum of 35 additional paying guests to the Prize tour at regular program fees (see Rule #8 for more information). The Sponsor is not responsible if weather conditions, event cancellations, strikes, lockouts, labour disturbances or other events beyond Sponsors reasonable control limit or restrict access to any of the planned excursions or locations on the tour. The Prize winner and his or her Travel Guests must each have proof of valid travel documents prior to ticketing and the right to fly and to enter the destination country or countries as outlined on the selected tour itinerary. The winners Travel Guests must be between eleven (11) and eighteen (18) years of age, inclusive, and the winner must sign and return a Group Leader Agreement agreeing to be the liaison between EF Educational ToursTM and his or her Travel Guests and acknowledging that, on tour, he or she will be solely responsible for monitoring the Travel Guests in his or her group and ensuring they adhere to the EF Educational ToursTM guidelines, rules and regulations, which will be provided to the winner upon the awarding of the Prize (see Rule #7 for more information), and are also available at http://www.eftours.ca/glagreement or upon request by calling 1-800-387-1460. The winner and his or her Travel Guests must travel on the same itinerary and are responsible for ground transfers to and from the designated departure airport (or other departure site, as may be the case should the Sponsor judge that air travel is not required due to the winners proximity to the tour destination). All expenses not otherwise specified herein, including but not limited to: departure fees, gratuities, optional excursions, tour extensions, insurance, medical travel documents, passport and/or visa fees, beverages and meals not specifically outlined in the selected tour itinerary, and personal expenses are the sole responsibility of the winner and his or her Travel Guests. The Sponsor provides no conditions, representations or warranties with respect to the Prize, including as to merchantability of fitness for purpose. No Global Rewards Points, frequent flyer miles, or travel rewards of any kind will be available on this Prize, and the EF Educational ToursTM Travel Grant will be adjusted based on the discounted Program Fee, at the sole discretion of the Sponsor. In no event will the Sponsor be liable for more than one (1) Prize. The Prize is not transferable. All EF Tours are subject to EFs Booking Conditions (the terms of which can be obtained by calling 1-800-263-2806 or found at http://www.eftours.ca/bc. Each potential Prize winner will be required to review and agree in writing to such Booking Conditions in advance of being awarded any Prize. A condition of accepting and being awarded such Prize will be compliance in full with such Booking Conditions.
4. PRIZE DRAW: A random Prize draw will be held on July 16, 2012 at approximately 10:00 AM EST at 60 Bloor Street West, Suite 501, Toronto, Ontario, from among all eligible entries received by the Contest Closing Date. The odds of being drawn as a potential Prize winner depend on the total number of eligible entries received during the Contest Period.
5. NOTIFYING THE POTENTIAL WINNER: The selected entrant in the Prize draw will be contacted by mail, courier and/or telephone within seven (7) business days of the Prize draw. If a selected entrant cannot be located or does not respond within seven (7) business days of notification, or if a package sent by mail or courier is returned as undeliverable, the selected entrant will be disqualified and another entrant randomly selected until contact is made with a selected entrant or no more entries are available, whichever occurs first. The Sponsor will not be responsible for failed attempts to notify any selected entrant.
6. DECLARING THE WINNER: In order to be declared a Prize winner, the selected entrant must first correctly answer a time-limited mathematical skill-testing question without assistance of any kind and will be required to sign and return a Declaration and Release Form (the Release Form) which confirms compliance with the Contest Rules and releases the Sponsor and its subsidiaries, affiliates, related companies or agencies, and their respective officers, directors, employees and agents (collectively the Releasees), from all liability with respect to the participation in the Contest by the winner and the acceptance of the Prize as awarded, without substitution, by the winner and his or her Travel Guests. The Release must be returned within the time period specified on the Release or the Prize will be forfeited by such winner. The selected entrant may be required to furnish proof of identification as part of the verification process. The Sponsor also reserves the right to require proof of eligible employment as required by Rule #2 (the Employment Confirmation). The Sponsor reserves the right to disqualify any potential winner who cannot produce, within five (5) business days of a request by Sponsor for same, proof of such employment (satisfactory to Sponsor). Should a selected entrant be unable to accept the Prize because of school and/or Board of Education policy, a new entrant will be randomly selected from among all eligible entries. A selected entrant shall be deemed ineligible if he or she has won a prize in any similar contest run by the Sponsor in the last twelve (12) months preceding the Contest Period. If the Prize is forfeited by a potential winner for any reason whatsoever, the Prize may be awarded to an alternate winner in the Sponsors discretion.
7. AWARDING OF THE PRIZE: A Tour Consultant/Tour Manager will contact the confirmed Prize winner within ten (10) days of receiving the duly completed Release and, if requested, the Employment Confirmation. The Tour Consultant/Tour Manager will book the travel arrangements for the Prize winner, including confirming the selected tour itinerary and who the Prize winners up to five (5) Travel Guests will be (the Prize Booking). The Prize winner will be responsible for ensuring that his or her Travel Guests have the appropriate documentation completed and returned within the time period specified by the Tour Consultant/Tour Manager. The Travel Guests will be required to provide the Sponsor releases similar to the Release provided by the Prize winner, or they may not be eligible to participate in the Prize tour. The Sponsor will not replace or refund any amount if the winner or any of the Travel Guests cannot attend the Tour. The Prize winner may not charge any fee to or obtain any compensation from any of the Travel Guests. No changes may be made to the dates for the Prize by the winner or his or her Travel Guests after the Prize Booking.
8. ADDITIONAL GUESTS: The Prize winner will have the option of adding additional paying guests to the Prize tour at regular program fees, and the standard EF Educational ToursTM free place ratio shall apply to all full-paying
guests. The Tour Consultant/Tour Manager will provide a formal quote with complete costs per guest and information for facilitating this process. In no event will the Sponsor be liable for more than the number of Travel Guests included in the Prize as described in Rule #3.
9. NAME AND IMAGE OF THE WINNER: By entering, each applicant, if he or she is selected as a potential winner of the Prize, consents to the use of his or her name, school name, city and province of residence/school, and/or photographs, without further remuneration, in connection with any publicity carried out by or on behalf of the Sponsor. The Travel Guests, by participating in the Prize, provide similar consent. The Sponsor and/or its affiliates, related companies or agencies, and their respective employees and agents, will have the right to photograph the Grand Prize winner and his or her Travel Guests while on the Grand Prize tour for use in future promotions, without further remuneration.
10. GENERAL CONDITIONS:
(a) This Contest is subject to all federal, provincial and municipal laws and regulations.
(b) All entries become the property of the Sponsor and none will be returned. No correspondence will be entered into except with the selected entrant.
(c ) By entering the Contest, all entrants release the Releasees from any loss, damage or claims caused by or resulting from participation in the Contest, or the acceptance or use of the Prize, including but not limited to any injury or damage to an entrants or to any other computer.
(d) The Sponsor is not responsible for typographical or other errors in the offer or administration of the Contest, including but not limited to, errors in advertising, the Contest Rules, or the announcement of the Prize winner.
(e) No responsibility is assumed by the Sponsor for any inability of any person to successfully enter the Contest for any reason, including any problems or technical malfunction of any internet or telephone network or broadcast transmission during the Contest. The Sponsor assumes no responsibility for falsified, late, lost, damaged, misdirected, garbled, or incomplete entries. Proof of transmission (screenshots, etc.) does not constitute proof of delivery.
(f) The Sponsor reserves the right at its sole discretion to disqualify any entrant from the Contest in the event it is determined that he or she has entered in a fashion not permitted by the Contest Rules or any other pertinent terms or conditions referenced in the Contest Rules.
(g) Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified.
(h) Any attempt by an entrant or any other person to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws. Should any such attempt be made, the Sponsor reserves the right to seek remedies and damages from any such person to the fullest extent permitted by law.
11. FOR RESIDENTS OF QUÉBEC: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie des alcools, des courses et des jeux only for the purpose of helping the parties reach a settlement.
12. CHANGE OR TERMINATION: The Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux in Quebec, to terminate, suspend, or modify this Contest without liability in the event of any fraud or technical failures of the website beyond the control of the Sponsor that may corrupt the administration, integrity or security of the Contest, or if any other factor interferes with the conduct of this Contest, without prior notice or publication. In the event of early termination of the Contest, a notice will be posted online and a random draw to award the Prize will be conducted from among all eligible entries received prior to the time of termination.
13. LANGUAGE: In the event of any discrepancies between the English language rules and the French language rules for this Contest, the English language rules shall prevail.
14. PERSONAL INFORMATION: The Sponsor respects your right to privacy. By entering this Contest, each entrant consents to the Sponsor collecting, storing and using the personal information submitted with his or her entry in accordance with its privacy policy, including for the purposes of (a) administering this Contest (b) contacting the entrant in connection with future contests, © communicating with the entrant in regards to its wares and services. The Sponsor shall deal with such personal information in keeping with the Sponsors Privacy Policy which can be obtained by calling 1-800-263-2806 or found at http://www.eftours.ca/privacypolicy.
